Shareholder Janet G. Abaray Appointed to The Ohio Constitutional Modernization Commission.
Burg Simpson Eldredge Hersh & Jardine, P.C. is pleased to announce that Janet G. Abaray has been appointed to The Ohio Constitutional Modernization Commission. Ms. Abaray is one of 20 public members of a Commission chosen from over 300 applicants that has been formed by the State of Ohio to consider modernization of the Ohio constitution. Ms. Abaray was selected to serve on the Commission by a 12-person, bipartisan group, of six Ohio State Representatives and six Ohio State Senators. Other public members of the Commission include former public office holders, including Governor Robert Taft, as well as judges, professors, attorneys and community leaders.
Speaking of her appointment Ms. Abaray said, “It is certainly an honor to be selected to serve on the Ohio Constitutional Modernization Commission. I look forward to collaborating with the other members to develop recommendations which protect the interests of Ohio citizens.”
The Ohio Constitutional Modernization Commission is charged under R.C. 103.61 with: studying the Constitution of Ohio; promoting an exchange of experiences and suggestions respecting desired changes in the Constitution; considering the problems pertaining to the amendment of the Constitution; and making recommendations from time to time to the general assembly for the amendment of the Constitution. In the event of a vote by Ohio citizens for a constitutional convention [Issue One], the Commission will act in an advisory role to the state legislature regarding convention organization and provide recommendations on convention proceedings. The Commission will make its first report to the Ohio general assembly not later than January 1, 2013 and is expected complete its work on or before July 1, 2021.
Janet G. Abaray is the managing shareholder of Burg Simpson’s Cincinnati office and practices in the area of complex civil litigation. She graduated Phi Beta Kappa and summa cum laude from the University of Cincinnati McMicken College of Arts and Science in 1979, with high departmental honors in English literature. She graduated Order of the Coif from the University of Cincinnati College of Law in 1982, where she also served as Business Manager of the Law Review. A member of the Ohio Bar since 1982, Ms. Abaray has focused her practice on complex civil litigation, with a particular emphasis on pharmaceutical mass tort. She has served as national lead or liaison counsel in numerous multidistrict litigations involving medical products, has been appointed lead counsel in class actions involving contract disputes, and has acted as trial counsel in major class action and pharmaceutical litigations. Ms. Abaray has argued before the Ohio Supreme Court concerning the constitutionality of tort reform, and has litigated significant issues concerning employment law, federal preemption, admissibility of expert testimony, arbitration clauses and class action certification.
