Burg Simpson trial lawyer David K. TeSelle and his trial team of Patrick Sweet, Caroline Nohl and Emily Coop won a jury verdict in favor of Burg Simpson client BluSky Restoration Contractors, LLC and against numerous defendant entities who were operating hotels nationwide as the Platinum Companies. The jury found for BluSky on all claims, and all amounts requested, awarding BluSky the full amount of the outstanding invoices, finding the Platinum Companies not only owed the money, but that they wrongfully used BluSky’s work to get paid by their insurance company for BluSky’s work, but then converted the monies and engaged in a civil conspiracy to keep the insurance proceeds for themselves. With contract interest, attorneys fees, and costs, the judgment is expected to be approximately $3 million.

“We are very pleased with the verdict,” TeSelle said, “today this jury sent a loud and clear message that in Colorado when you make a promise, you have to keep it.”

BluSky Restoration Contractors, LLC is one of the leading disaster mitigation and restoration contractors in the country, with its home office in Arapahoe County, Colorado.
