Colorado Jury Awards Million Dollar Verdict To Arapahoe County-based Disaster Restoration Contractor Who Was Stiffed On Its Bill For Disaster Relief Work
Burg Simpson trial lawyer David K. TeSelle and his trial team of Patrick Sweet, Caroline Nohl and Emily Coop won a jury verdict in favor of Burg Simpson client BluSky Restoration Contractors, LLC and against numerous defendant entities who were operating hotels nationwide as the Platinum Companies. The jury found for BluSky on all claims, and all amounts requested, awarding BluSky the full amount of the outstanding invoices, finding the Platinum Companies not only owed the money, but that they wrongfully used BluSky’s work to get paid by their insurance company for BluSky’s work, but then converted the monies and engaged in a civil conspiracy to keep the insurance proceeds for themselves. With contract interest, attorneys fees, and costs, the judgment is expected to be approximately $3 million.
