Although touted as faster, cheaper, and “just as fair” as court litigation, many complain that arbitration has serious flaws and deprives consumers of their right to a jury trial before the nature and gravity of a dispute can be gauged. The article examines if and when the results of a homeowner or other consumer arbitration can be used against a business in a later arbitration, the effect of arbitration confidentiality on such later use, and whether homebuilders can set up separate subsidiaries for each home or neighborhood they build so as to avoid the binding effect of earlier construction defect arbitrations they have lost.
