Burg Simpson Features: Attorney David P. Hersh

David P. Hersh is a shareholder and the co-practice group leader of the business and commercial litigation department of Burg Simpson. Mr. Hersh focuses his practice on complex commercial matters involving business interruption insurance claims, including those due to the COVID-19 pandemic, contract disputes, breach of fiduciary duty, ownership disputes, construction matters, “bet your company” litigation, and professional negligence.

Businesses across the U.S. have experienced the loss of business income as a result of government mandates requiring closures due to COVID-19. Although most business insurance policies include coverage for loss of business income caused by an interruption due to an event outside their control, insurance companies have continued to deny claims.

Although the insurance industry refuses to pay these claims, David Hersh and his team in Burg Simpson’s Commercial Litigation Department believe many business insurance policies actually do provide coverage for these kinds of losses. A careful examination of the insurance policy is critical for determining whether the loss of business income from the government ordered shut-down is covered by the policy.

Burg Simpson has more than 40 years of experience successfully litigating bad faith insurance claims. They know how best to structure their clients’ cases to maximize the potential of getting the insurance companies to pay the benefits owed. Mr. Hersh and his team of attorneys at Burg Simpson have successfully sued insurance companies for bad faith collecting millions of dollars for their clients when insurance companies improperly denied, underpaid, or “slow paid” claims.

Admitted to practice before the United States, Colorado, and Wyoming Supreme Courts, as well as numerous Federal Courts, David Hersh is a skilled and experienced trial lawyer who excels in the courtroom. He expertly handles all aspects of litigation through his creative problem solving, persuasive communication, and outstanding analytical skills. He believes that the benchmark of his success comes from his passion for the law and steadfast mission to be the best advocate possible for his clients.

Consistently recognized by his peers, Mr. Hersh has been selected by Super Lawyers, Best Lawyers in America, The National Trial Lawyers, 5280 Top Lawyers, Law Week Colorado’s Barrister’s Best, and the American Board of Trial Advocates. In 2015, David P. Hersh also attained the “Top Ten” status by Colorado Super Lawyers. He is one of only 15 Colorado attorneys who has received this distinction.
