Choosing a Physician After Your Work-Related Injury.

If you have suffered from a work-related injury, it is important to notify your employer as soon as possible to ensure that your workers’ compensation coverage pays for your medical treatment.  After you have notified your employer that you have been hurt, your employer must provide you with the names of at least four different physicians or facilities. There must be at least two that have different ownership. The selection of the doctor can be very important because once that selection is made you have very limited ability to change. You don’t want to choose a physician simply because their location is convenient.  If you not yet chosen a doctor, consider consulting with an attorney who specializes in Colorado Workers’ Compensation issues to discuss your rights and options according to Colorado law.

Once you select a doctor, he or she will recommend a course of treatment, determine when you have reached maximum medical improvement, and decide when you are able to return to either full or partial duty at work.

It is important to know that in some cases, the doctor recommended by your workers’ compensation insurer may have a stronger sense of loyalty to the insurer rather than to you as the patient. In these instances, the doctor may make decisions regarding your treatment and when to release you, based on the needs of the insurer rather than your needs to obtain the best possible medical care.

If you believe you are not receiving the best possible treatment from your physician, or that the workers’ compensation insurer is not paying for all of the medical and other benefits that you deserve, you should consult with a Colorado workers’ compensation attorney who can assist you as soon as possible.
