Construction Defect Team Secures a $19.48 Million Dollar Award
Following a lengthy arbitration, Burg Simpson shareholder Mari Perczak, and her team of construction defect trial lawyers, secured a $19.48 million award for a 17-building, 82-unit residential common-interest, townhome community in Aurora, Colorado. The case was filed against Century Communities, Inc., a publicly-traded home building company operating in multiple states, and related corporate entities that acted as the developer, builder and general contractor for the Project.
Burg Simpson’s construction defect trial team included shareholder Mike Menghini and trial lawyer Ryan Pardue with contributions from shareholder Diana Sada and trial attorney Joe Smith. The association alleged that common elements and individual units suffered from numerous construction defects and deficiencies. Multiple engineers and cost estimating experts testified during the over 17-day arbitration about, in part, structural, geotechnical, and civil engineering-related issues. In a reasoned award, the arbitrator found each of the Century entities liable for the association’s claims for breaching the duty to construct the project with reasonable care.
A hearing on costs and attorneys’ fees is scheduled for December and could result in an increased final award.
