Aspen Dog Sled Adventure Negligence Leads to $1 Million Recovery

Denver, Colorado – Burg Simpson Eldredge Hersh and Jardine, P.C. has obtained a $1 million judgment against Krabloonik, Inc. in Colorado Federal Court. Krabloonik, Inc., an Aspen-based dog sledding business, was sued for negligence and premises liability after a serious dog sledding incident in 2012 involving Harry and Melody Harden of Charlotte, North Carolina. The Court’s entry of judgment against Krabloonik is a determination that the Hardens are entitled to be compensated for the negligent acts of Krabloonik.

The incident was caused by excessive speed, lack of skill by the musher, icy conditions, and defective equipment. The musher lost control of the Harden’s sled, causing it to flip over and eject the Hardens face first into a tree at the side of the trail. Both of the Hardens experienced severe, permanent, and debilitating injuries that required extensive reconstructive surgery.

In their lawsuit filed against Krabloonik, the Hardens sought economic and noneconomic damages as well as damages for permanent impairment and disfigurement. Krabloonik agreed to allow this judgment to be taken against it rather than proceed to trial before a jury.
