For example, in the Tri-State area, Burg Simpson’s Cincinnati attorneys have successfully represented individual plaintiffs in numerous cases involving motor vehicle collisions, tractor roll-overs, defective pharmaceutical products and medical devices, contract disputes, wrongful terminations, employment discrimination, and more.  In terms of complex litigation, Janet Abaray secured recovery for 8,000 Midwest farmers in a class action about the cancellation of Chubb drought insurance, hundreds of Cincinnati medical doctors in a class action over the sale of the ChoiceCare HMO, and hundreds of Cincinnati Enquirer paper delivery route owners in a consolidated breach of contract claim.   Of particular interest, she successfully represented 40,000 season ticket holders of the Cincinnati Bengals football team concerning their seat licenses in Paul Brown Stadium, providing all affected season ticket holders with money back or the opportunity to relocate their seats.  In addition, Melanie Bailey has acted as court-appointed lead counsel in a wage and hour class action in Kentucky on behalf of WalMart employees.  She also represented dozens of local medical patients in a consolidated case filed against a device manufacturer after they were harmed by an experimental laser treatment used during spinal surgery.

Of particular note, Janet Abaray has been court appointed as Co-Lead Counsel in the Depakote Products Liability Litigation and the Ortho Evra Products Liability Litigation, as national Liaison Counsel in the Ephedra Products Liability Litigation, as a member of Plaintiffs’ Lead Counsel Committee in the Heparin Products Liability Litigation, and served as Co-Chair of the Science Committee in the Yaz/Yasmin Products Liability cases.
