Drivers Sue Universal Transportation Systems, LLC for Illegal Wage Practices
On February 13, 2017, Edward Williams and Anthony Casey filed a class action and collective action lawsuit in federal court against Winton Transportation, Inc. d/b/a Universal Transportation Systems, LLC (“Universal”) alleging that Universal’s pay practices violated Ohio and federal laws.
According to court filings, Universal is based in Fairfield, Ohio and provides transportation services to over 2,000 clients per day. To transport this many individuals, Universal employs over 250 drivers, including Williams and Casey.
Williams and Casey allege that Universal estimates how long its drivers work during the day and pays its drivers based upon these estimations instead of the actual hours worked, as logged on their timesheets. Similarly, Universal fails to compensate its drivers for time spent on work-related tasks or times when drivers are “on-call” and unable to engage in personal activities.
The legal filings indicate that Universal’s timekeeping practices resulted in its drivers being paid less than minimum wage and less than the hourly wage for which they agreed to work. Universal’s practices also resulted in drivers not being compensated appropriately for overtime hours.
Williams and Casey’s lawsuit seeks to represent current and former Universal drivers who were subject to the same pay practices that they allege violate state and federal laws.
