If you or a family member has been injured or your life has been upended as a result of a dangerous or defective medical device, the Cody, Wyoming attorneys at Burg Simpson can help. We have more than 40 years’ worth of experience in dealing with medical device claims, such as:
- Heart valves
- Artificial joints
- Knee joint replacements
- Gadolinium dyes
- Artificial hip replacements
Artificial hip replacements are one area where the attorneys at Burg Simpson have focused their attention over the last several years. A hip replacement, which is called referred to as hip arthroplasty, replaces an injured or diseased hip joint with an artificial implant. These implants, whether it is the material, the handling, or the installation can lead to a host of medical issues, some of which can cause serious harm to patients.

A growing number of hip replacement patients are reporting serious problems with their Wright PROFEMUR® Hip System implants. Manufactured by Wright Medical Inc., the Wright PROFEMUR® Total Hip System is a modular implant, comprised of a femoral stem, modular neck, and femoral head, mated with an artificial acetabular cup.
Evolving evidence in the United States has shown that certain models of the modular neck might suddenly – and without warning – break a few short years after implant. According to data reported to the Australian Orthopaedic Association, the early failure rate of the Wright Medical PROFEMUR® could be as high as 11.2 percent – well above industry averages.
To date, there have been hundreds of reports of modular neck fractures of the Wright Medical PROFEMUR® Hip System made to the U.S. Food and Drug Administration. Given the nature, time, and location of these reports, it would appear the problem is not tied to a single “lot” of devices. Based on Wright Medical’s published marketing information, there could be as many as 100,000 similar modular necks implanted to date.
There are numerous models of Wright Medical modular necks, all of different angles and lengths. Further investigations carried out by Burg Simpson’s team of Wyoming attorneys has shown that individuals fitted with “long” necks, weighing more than 230 pounds, and with an active lifestyle have experienced a higher rate of failure than others who have these devices.
If you or a loved one has experienced serious pain or needed corrective surgery following the failure of a Wright Medical artificial hip implant, you could be entitled to compensation. It is absolutely critical that you get in touch with a skilled trial attorney as soon as possible. If you wait, the evidence required to help establish your case could be lost, damaged, or even destroyed. In addition, statutes of limitations establish strict time limits where these lawsuits can be filed. Call Burg Simpson Wyoming at 307-527-7891 and speak to a trial lawyer today.
A growing number of metal-on-metal hip replacement patients are reporting serious problems with their Wright CONSERVE® MoM hip replacement systems. Manufactured by Wright Medical Inc., the Wright CONSERVE® is a modular implant, comprised of a femoral stem, modular neck, and femoral head, mated with an artificial acetabular cup.
Burg Simpson shareholder Peter W. Burg has a leadership role in the California JCCP. Active in the Wright MoM litigation – both the Conserve Cup loosening cases and the ProFemur neck fracture cases – Burg Simpson is working with a group of lawyers who are pursing the Conserve Cup cases in a consolidated action in California through the JCCP process. There’s also a Multi District Litigation pending in Georgia for the Conserve Cup cases; however, Burg Simpson is concentrating its resources in the California JCCP.
More than a dozen cases have been filed to date against Wright alleging failure as a result of cup loosening and metallosis. A petition for MDL treatment of the Wright CONSERVE® hip litigation was filed in November of 2011, and on Feb. 8, 2012, the Judicial Panel on Multi District Litigation transferred all cases to Judge William Duffy Jr. in the Northern District of Georgia (in Atlanta) for pre-trial proceedings. Additionally, there are cases pending against Wright Medical in California State Courts that have been coordinated in front of a single judge.
