Meet Our Attorneys

Michael S. Burg founded Burg Simpson Eldredge Hersh & Jardine PC in 1977 because he wanted to make a difference in people’s lives. For the past 40 years, Burg Simpson has been doing just that. We’ve been able to secure more than $1 billion (and counting) in compensation for injuries our clients have suffered. We’ve grown from a one-man shop to a successful law firm with more than 60 experienced attorneys and dozens of compassionate paralegals.

Former U.S. Senator Alan K. Simpson, R-Wyoming, is the “Simpson” in Burg Simpson. Alan served in the Senate from 1979 to 1997, where he rose to become the assistant Republican Leader. Alan also helped found the Wyoming Trial Lawyers Association while serving with several public service groups, such as: the Continuity of Government Commission, Americans for Campaign Reform, the National Commission on Writing, and the Advisory Board of Common Good, a coalition dedicated to legal reform.

Shareholder Peter W. Burg’s professional practice centers on litigation in a wide range of areas. Over the years, Peter has developed a national reputation as a trial lawyer through his work with cases involving product liability, personal injury, and mass tort litigation. Peter has been recognized by the Legal 500 as a “particularly strong and intelligent leader” and shows “the ability to try cases when necessary and to settle cases for top value when settlement is clearly in the client’s best interest.”

Shareholder Scott J. Eldredge has been practicing law continuously with the firm since his admission to the Colorado Bar in 1983. Scott’s practice focuses on complex medical malpractice, personal injury, wrongful death and large product liability cases, as well as mass tort litigation. For four straight, Law Week Colorado recognized Scott as Barristers’ Best Medical Malpractice Lawyer from 2010-13 and awarded him the People’s Choice Award as Colorado’s Best Medical Malpractice Attorney in 2009.

Shareholder David P. Hersh, who is co-chairman of Burg Simpson’s commercial litigation department, is responsible for all types of commercial trial work. David deals with cases concerning business dissolution, breach of fiduciary duty, shareholder derivative actions, breach of contract, protection of confidential business information, management disputes, and other business disputes. David handles disputes relating to all sorts of corporate structure including corporations, limited liability companies, and limited liability partnerships, among others.

Kerry N. Jardine is the managing shareholder at Burg Simpson Eldredge Hersh & Jardine, P.C and serves on the executive committee. Kerry’s been critical in the Burg Simpson’s management, practice group formation, global strategy, and direction for more than 20 years. Kerry litigates extensively in a wide range of personal injury actions, including automobile and trucking accidents, unsafe products, and gas explosion cases. Before earning his JD/MBA Brigham Young University in 1987, Kerry worked several years for a Fortune 500 company. Kerry joined Burg Simpson in 1989.

Shareholder Stephen J. Burg is a trial lawyer whose personal injury practice is focused on representing victims of car accidents, trucking accidents, brain injury, spinal cord injury, wrongful death, burn injuries, and many more. Stephen has been recognized for his legal excellence both nationally and locally. He was named as a “Recommended Attorney” by the U.S. Legal 500. He is named a “Top 100 Trial Lawyer” by the National Trial Lawyers. 5280 magazine has named Mr. Burg a “Top Lawyer.” Mr. Burg has been admitted as a member of the “Multi-Million Dollar Advocates Forum” and was named Law Week Colorado’s “Compleat Lawyer”.

Shareholder Nick Fogel is department head of our workers’ compensation practice devoted to helping those who have been injured while on the job and in the line of duty. In this capacity Nick has extensive courtroom experience handling a wide variety of matters. In 2010, Nick was selected by Law Week Colorado as one of Colorado’s Up-and-Coming Lawyers, a distinction given to attorneys who are at most in their sixth year of practice and have already accomplished tremendous things professionally and in the community. Nick has also been selected by the National Trial Lawyers for inclusion in The Top 40 under 40 Association.

Shareholder Seth A. Katz joined Burg Simpson in September 2005 after six years with the New York law firm of Seeger Weiss, where he was a partner. Seth focuses his practice primarily in the areas of complex, pharmaceutical mass tort, and class action litigation including consumer protection, securities fraud, products liability, and commercial litigation. In addition to his varied professional experience, Seth is a frequent speaker on electronic discovery and pharmaceutical litigation. Seth’s current practice involves primarily complex and class action litigation on behalf of aggrieved consumers, corporate shareholders, and property owners, and pharmaceutical mass tort litigation on behalf of those injured as a result of their ingestion of prescription medications and the implantation of medical devices.
