Michael Burg to Receive Colorado Trial Lawyers Association’s Lifetime Achievement Award!

We are pleased to announce that Michael S. Burg is this year’s recipient of the Kenneth Norman Kripke Lifetime Achievement Award, presented by the Colorado Trial Lawyers Association.

 With this award, the CTLA recognizes an attorney member whose longstanding career has exemplified the skills, ethics, and dedication embodied in the CTLA’s “ongoing effort to preserve and improve the American system of jurisprudence.”

Court of Appeals Reinstates $58.5 Million Judgment Against Body Brokers

Burg Simpson’s clients won again when the Arizona Court of Appeals reinstated the full $58.5 million judgment against the former owner of Biological Resource Center (BRC) for selling donated bodies for profit on the black market. The Court of Appeals ruled that the Trial Court had erred in reducing the jury’s $50 million punitive damages award.

After the jury trial, the Trial Court ruled that the punitive damages award was constitutionally excessive and reduced it to $8.5 million (for a total of $17 million in damages). The Burg Simpson trial team then filed an appeal on behalf of the Donor Families and the Court ruled in their favor, finding the Trial Court did not have the jurisdiction to reduce the award and ordered the Trial Court to reinstate the original judgment of $58.5 million.

The $58.5 million jury award was one of the largest civil jury trial awards in Arizona history. Burg Simpson’s trial team included Michael S. Burg, David K. TeSelle, Holly B. Kammerer, and Paul D. Friedman.

Thomas Henderson Elected Secretary of CBA’s Insurance Committee

Burg Simpson is pleased to announce that Shareholder Thomas W. Henderson has been elected to serve as Secretary of the Insurance Committee of the Colorado Bar Association.

The aim of the CBA’s Insurance Committee is the promotion and advancement of the insurance legal profession in Colorado. The committee is open to any attorney who practices Insurance Law in Colorado. The Insurance Committee strives to bring together attorneys who represent insurers and policyholders as well as those who are further engaged in matters involving Colorado Insurance Law. The Committee seeks to promote professionalism, education, camaraderie, and the advancement of insurance law.

Thomas Henderson

Tom Henderson focuses his practice on representing policyholders in suing insurance companies for bad faith and getting insurance companies to pay what the insurance policy promises to pay.
