Attorney James Heckbert Secures Win for Skier in Ski Accident

Accidents on the ski slopes can have life-changing consequences. That’s why it’s critical for ski accident victims to have strong and experienced lawyers to fight for their rights when they have been injured.

That’s what happened when Burg Simpson Senior Counsel James Heckbert represented Patricia Klug and he secured a verdict for his client on September 22, 2018 in Klug vs. Bross.

This case was a matter of two skiers colliding on the slopes at Arapahoe Basin in March of 2014.   The Plaintiff Patricia Klug claims that on March 20, 2014, she was skiing at Arapahoe Basin Ski Area, when she was struck by the Defendant. As a result of being struck, Ms. Klug fell to the ground and suffered fractures to the right side of her pelvis and sacrum. Ms. Klug claimed the Defendants violated the Colorado Ski Safety Act by:

  1. Failing to ski within the range of her ability;
  2. Failing to maintain control of her speed and failing to maintain a proper lookout so as to be able to avoid Plaintiff Patricia Klug;
  3. Failing to yield to Plaintiff Patricia Klug who was skiing downhill from Defendant;
  4. Acting in a manner which caused or contributed to injuries sustained by Plaintiff Patricia Klug.

Patricia Klug claims that as a result of her injuries she was hospitalized, has incurred medical expenses, and continues to suffer from physical pain and impairment.

The most significant part of this verdict was that it was against a child who was 11 years old at the time of the accident. Mr. Heckbert was able to clearly present to the jury that all skiers, even children, must abide by the safety rules of the Colorado Ski Safety Act.
