Burg Simpson shareholder and trial lawyer David P. Hersh has been selected to receive the CHARLES B. DILLON AWARD OF MERIT FOR OUTSTANDING PUBLIC SERVICE by the ARAPAHOE COUNTY BAR ASSOCIATION.  This prestigious award is presented by the Arapahoe County Bar Association to an individual for extraordinary service in the public interest.

Dave has been in service to the Arapahoe County Bar Association (ACBA) for many years, serving as its President in 2016 and 2017. Following his tenure as President, Dave has continued to serve the ACBA in various capacities, including as Chair of the ACBA Lawyer Well-Being Committee.  The Lawyer Well-Being Committee is charged with the responsibility for raising awareness of lawyer well-being issues, providing assistance to members regarding available resources, and normalizing the essential conversations around issues such as substance abuse, mental illness, and end of practice issues facing our members. Concurrently, Dave serves on the Colorado Supreme Court Lawyer Well-Being Task Force, the Colorado Pilot Project on Well-Being for Legal Employers, and the Wyoming Bar Association Well-Being Committee.  Through these public service activities, Dave not only assists individuals in their pursuit of well-being,  but also creates and enhances a culture of well-being and acceptance in the legal community.  Dave’s work with legal employers is an important aspect of promoting and encouraging cultural change to enhance well-being. His leadership and advocacy regarding well-being is a natural fit for Dave based on his penchant for living an active and healthy lifestyle.  As a lawyer with 30+ years of active recovery from alcohol abuse, Dave encourages those suffering from substance abuse and mental health challenges to seek and obtain the support and care they need to live their best lives.  Dave enjoys sharing his Experience, Strength, and Hope with individuals and organizations.

About David P. Hersh

For more than 35 years, Dave has focused his practice on civil trial work.  Dave thrives on handling complex civil cases, presenting them simply, effectively, and persuasively to a jury.    Dave has tried well over 145 civil jury trials to verdict and has “tried” scores of civil arbitrations and bench trials to their conclusion, with an outstanding “win” record in all venues.  Dave has dedicated his life to advocating for others in their time of need.

Dave is one of the practice group leaders of the business and commercial litigation department of Burg Simpson.  He focuses his practice on complex commercial matters involving contract disputes, breach of fiduciary duty, ownership disputes, construction matters, “bet your company” litigation, COVID-19 Business Interruption Claims, and professional negligence. Admitted to practice before the United States, Colorado, and Wyoming Supreme Courts, as well as numerous Federal Courts, Dave has tried civil jury trials to verdict throughout the United States. In addition, he has served as lead counsel in a substantial number of complex commercial litigation cases as well as a number of catastrophic personal injury cases, including cases involving claims for brain injury, paraplegia/quadriplegia, severe burns, and disfigurement, and limb loss. Dave has handled a number of “toxic torts”, including being appointed class counsel for more than 65,000 residents of Colorado Springs to redress contaminated groundwater.

A skilled and experienced trial lawyer, Dave excels in the courtroom, expertly handling all aspects of litigation through his creative problem solving, persuasive communication, and outstanding analytical skills.
