After nearly three years of litigation, including several continuances occasioned by COVID-19, Burg Simpson trial lawyers David P. Hersh and Dean D. Batchelder, with the able assistance of our professional legal staff, successfully resolved a multi-million-dollar commercial dispute on the eve of a two-week jury trial scheduled for the following Monday.  Burg Simpson represented a national sales and use tax consulting firm that saved a Fortune 500 company millions of dollars in overpayments.  When the defendant decided not to pay Burg Simpson’s client for the work completed and the savings accomplished, Burg Simpson filed suit to recover those fees.  The resolution of the suit and payment of the fees due was achieved on Friday before the trial began.  Burg Simpson was prepared to go to trial, the Court was prepared to hear the case, and the impending jury trial was the catalyst needed to drive the defendant to settle.

The commercial litigation trial lawyers at Burg Simpson Eldredge Hersh & Jardine are ready, willing, and eager to take your case to trial if necessary.  Burg Simpson’s attorneys have a longstanding reputation for being “trial-ready,” and their preparedness combined with their “Lemme at ‘em” mentality positively influences the settlements they obtain for their clients.

If you have a commercial lawsuit, either as a plaintiff or defendant, you need a team of experienced trial lawyers to represent you and your best interests. You need a team that has the skill to effectively prepare your case for trial and powerfully present your case to the jury.  With the experienced and award-winning team of Burg Simpson trial lawyers on your side, the likelihood of case settlement increases, as does the case settlement value. Impending trials drive serious settlement discussions. When your attorneys are “trial-ready,” the power of their position often forces the opposition to realistically evaluate the strength of their case and the inherent risks involved.
