“A Deeper Look at CDARA’s Scope” co-authored by Ronald M. Sandgrund and Leslie A. Tuft

Burg Simpson construction defect trial and appellate lawyers Ronald Sandgrund and Leslie Tuft have co-authored a recent article for The Colorado Lawyer entitled “A Deeper Look at CDARA’s Scope.” A link to the article is attached here. The article was prompted by concerns about the remedies available to Coloradans who might be injured or killed if Colorado was to sustain a tragedy similar to the collapse of the Champlain Towers hi-rise condominium in Surfside, Florida.

The Colorado Bar Journal (The Colorado Lawyer) just published an article in its August/September 2022 issue by Burg Simpson attorneys Ron Sandgrund and Leslie Tuft looking further into the scope of Colorado’s Construction Defect Action Reform Act (CDARA). This law, CDARA, governs nearly all Colorado construction defect claims and lawsuits. The article follows up on earlier article they wrote on CDARA’s scope, that is, what limits might apply to this law that can prevent homeowners from being saddled with unfair restrictions on their legal rights.

This latest article explores three important issues for homeowners and others who suffer damage or injury due to construction defects. First, whether someone hurt by a construction defect located on property they don’t own or lease can sue a construction professional whose negligence created the defect.  Second, whether and how CDARA might limit recovery for personal or bodily injury claims, and claims for wrongful death.  Last, whether property owners (and their insurers) can sue for damage to or the destruction of personal property (as opposed to real property) caused by construction defects. The article highlights  arguments available to innocent persons who suffer injury and losses due to construction defects so as to help make them whole.
