Arizona House Bill 2116 Provides Civil Action Against Perpetrators

Supporters of Arizona House Bill 2116 agreed that the state must hold perpetrators of sex and human trafficking accountable for their crimes and assist the victims in their attempt to rebuild their lives. In March of 2021, Arizona Governor Ducey signed the bill into law. House Bill 2116 was enacted to help victims of human and sex trafficking to pursue civil action against the perpetrators of the crimes. Additionally, it provides there is no statute of limitations for a victim to bring forward a private action. House Bill 2116 further provides that if the plaintiff prevails, they may also be able to recover damages for economic losses that occurred during the time of abuse and address the damages that were the result of their physical, mental, and emotional suffering. Punitive and exemplary damages are also available.

  • Burg Simpson shareholder Scott Eldredge is also representing a victim of sexual abuse in a case that originated in Aspen, Colorado. The cycle of abuse, which occurred over a period of approximately four years, also resulted in a case filed against a member of the clergy.
