Michael Burg will be discussing various issues, including his role as a trial attorney at Burg Simpson, and how he has helped clients over the years obtain structured settlements rather than lump-sum payments from civil lawsuits. A structured settlement is set up as an annuity where the payee receives a guaranteed stream of income payments, rather than a single lump sum. These kinds of settlements usually offer certain tax advantages for the recipient and savings for the payer.
“When clients receive money from a lawsuit judgment or settlement, there may be tax consequences associated with the funds they receive. After collecting a settlement, the IRS generally regards that money as income and taxes it accordingly. However, every rule has exceptions, and the IRS does not tax award settlements for personal injury cases. Any income from personal injury settlements are exempt from local, federal and state taxes, and any accrued interest from the settlement contract is also tax-free.”
