By state statute, a terminated employee has the right to seek unemployment compensation. Generally, all such claims require the agency to determine whether the employee lost employment without fault (such as a lay off or where the employee could not meet the employer's requirements despite best efforts) or whether the employee was at fault for the separation from employment (such as insubordination or chronic absenteeism). An employee who is receiving unemployment compensation must seek to find other gainful employment and keep the agency informed of the employee's efforts.
