New Jersey Jury Decides in Favor of Merck in 2nd Vioxx Trial

A jury of six women and three men deliberated for less than 8 hours in the second Vioxx-related lawsuit to go to trial and handed Merck a key victory in the fight over its Vioxx painkiller. This finding means that Merck will not be held liable for the 2001 heart attack suffered by the plaintiff, Frederick "Mike" Humeston.
Michael S. Burg, senior partner of Burg Simpson and member of the Plaintiffs' State Liaison Committee for the Vioxx Multi-District Litigation, stated "New Jersey was a very difficult jurisdiction because there are numerous pharmaceutical companies located within the state, including Merck. Additionally, the plaintiff's attorneys went into the case knowing that it was a case of short-term use of the drug and didn't involve a fatal heart attack or stroke."
In Colorado, Mr. Burg estimates that there are approximately 2,000 cases filed against pharmaceutical giant Merck, with 380 of those cases being handled by Burg Simpson. Despite today's verdict, Mr. Burg stays optimistic and feels that future verdicts will be heavily sided with the plaintiffs. "We are very confident that future verdicts will be in favor of the plaintiff. This verdict doesn't change the fact that Merck was fully aware that Vioxx caused heart attacks and strokes, but even with that knowledge they continued to mislead doctors and consumers about Vioxx's safety to bolster revenue."
The next Vioxx trial is scheduled to begin on November 28th, in Houston, Texas.
