COLORADO COURT OF APPEALS AFFIRMS LARGE ATTORNEYS FEES AWARD TO BURG SIMPSON CLIENTS
On June 16, 2005, the Colorado Court of Appeals affirmed the Arapahoe County District Court's award of attorneys fees of almost $500,000 to Burg Simpson's clients, Morris Ginsburg and Irwin Sandler The fee award was the result of Burg Simpson's successful defense of a civil action brought by Milton Karsh, a former business associate of Ginsburg and Sandler. Karsh accused Ginsburg and Sandler of breach of contract and breach of fiduciary duties for allegedly selling nonassignable proxies. A jury found in favor of Ginsburg and Sandler, resulting in a defense verdict. The first appeal affirmed the trial court's rulings, and this appeal on the attorneys fees followed.
The trial team consisted of Mike Burg, Peter Burg and Diane Vaksdal Smith. When asked to comment, Peter Burg said: "This was a difficult, hard fought case that had numerous complex factual and legal issues. We are gratified that the court of appeals has twice upheld the trial court's decisions resulting in a great victory for our clients. The credit for these appellate successes goes to Diane Smith, the Burg Simpson appellate attorney, who handled the appeals for us."
