A negligent hiring, supervision or retention claim allows a third party who is injured by an employee to hold the employer liable, under certain conditions. Essentially, an employer has the duty to hire and or retain employees who do not pose a risk to third parties. For example, an employer may be liable for negligent hiring when an employee with an extensive history of moving violations is hired to drive a company vehicle and injures a pedestrian during the performance of the job duties.
