What constitutes medical malpractice?
Medical malpractice is when a health professional is negligent by failing to maintain minimum standards of acceptable care. Not every case of a medical mistake or failed treatment constitutes malpractice. Mistakes can happen and treatments can fail in the course of responsible medical treatment. These problems only rise to the level of malpractice when the health care provider is negligent in his or her delivery of medical care.
Who can be sued for medical malpractice?
n addition to doctors, any health care worker, including nurses and other health professionals, can be sued for medical malpractice if they are negligent in performing their duties.
In many cases, organizations such as medical clinics and hospitals can also be sued for medical malpractice, when the policies and other acts of that organization (through its agents) are found to be negligent.
How long do I have to file a suit for medical malpractice?
Each State has different statutes of limitations that apply to different types of claims. These statutes of limitation limit the amount of time you have to file a suit in court.
In cases of medical malpractice, the time is generally measured from the time that you knew or should have known of the injury. Cases involving minors often have a longer statute of limitation.

Both Psychiatrists and Psychologists are required to meet the minimum standard of care in their chosen field.
