Employment discrimination claims under Title VII are particularly appropriate for class action treatment. Title VII of the Civil Rights Act of 1964, as amended, provides individual plaintiffs the opportunity to seek redress against an employer as part of a group, allows broader discovery options, and a potential tolling of applicable statutes of limitation. Thus, litigants could seek class action certification for discrimination based on race, national origin, religion, sex, and pregnancy.
Litigants claiming to be adversely affected by discrimination based on age, under the Age Discrimination in Employment Act (ADEA), could also seek certification as a class. The general structure of ADEA is patterned after Title VII and provides many of the same rights and remedies as Title VII.
Litigants claiming to be adversely affected by discrimination based on disability under the Americans with Disability Act or the Rehabilitation Act could also seek certification as a class.
