Yaz® / Yasmin® Lawsuits:

1. Is BurgSimpson the best firm to handle my case?

Yes. There is no other firm in the country that has helped more women receive fair compensation. No other firm is currently helping more women. Our shareholders have led this litigation since 2009. Michael Burg was appointed to lead the national efforts by the federal judge overseeing the Yaz® litigation. Janet Abaray has served as a Co-Chair of the Science Committee, and Seth A. Katz has served as Chair of the Discovery Committee. We have fought this fight since day one and have the combination of powerful resources and expertise to give you the greatest chance to receive a successful outcome.

2. How many women has BurgSimpson helped?

To date, we have helped over 900 women receive compensation for the injuries they suffered from taking Yaz®. We continue to represent and help hundreds of others receive compensation.

3. What has BurgSimpson recovered for its clients?

BurgSimpson is proud to have recovered more than $500 million for clients who have been injured by defective drugs. Our strong national leadership has helped more than 10,000 men, women, and children receive billions in compensation.

4. Will it cost me anything to find out if I have a claim?

No. We pay for all of the costs such as obtaining your medical records, filing fees, and expert reviews, if necessary. If, and only if, Bayer pays your claim, do we receive reimbursement for costs we have paid on your claim. We only receive a fee if Bayer pays your claim. If there is no recovery for you, then you owe us nothing.

5. How long will it take me to find out if my claim qualifies?

Generally, we can advise you if you have a valid claim within 45 days from the date we receive your paperwork. We are very experienced in this process.

6. How do I get started?

Fill out the paperwork in your packet immediately. Our trained nurses and specialists are available to assist you with your packet whenever you need help.

7. What type of claims are compensable?

Generally, injuries involving blood clots, such as pulmonary embolism and deep vein thrombosis, are compensable. But your claim must be supported by your medical and prescription records. Once we have your signed medical authorizations, we can generally obtain these records quickly.

8. If I have a qualifying claim, when will I receive compensation?

Generally 8-10 months. It can be either shorter or longer, but the process is streamlined and efficient.

9. Is there confidentiality?

Completely. Your communications with us are protected by the attorney-client privilege. It is completely up to you with whom you share information about your case. We do advise that you keep this matter private.

10. Will I have to go to trial?

Bayer is currently settling pulmonary embolism, deep vein thrombosis, and similar blood clot-related cases. If your case qualifies, we believe we will be able to obtain a fair recovery for you without having to go to trial.

11. Will it be worth it to allow BurgSimpson to pursue a claim for me?

BurgSimpson has been able to obtain approximately $200,000 per case from Bayer. Some women have received more, some have received less. Ultimately, the value of your case will depend on the specific facts of your case, including your injuries, your medical condition, and the legal issues. If you have a claim, it is well worth your time to assert your rights.

12. How much time do I have?

We believe the time is short. We advise you to act now without delay. Most injured women have already submitted claims. It is not too late. However, if you are indecisive and do not act quickly to pursue your claim, you risk losing the opportunity to receive just compensation.

13. How did BurgSimpson discover the problems with Yaz?

In 2009, we discovered the incidence of injury with Yaz® was much higher than with other birth control drugs, even before the research
and warnings were public. We immediately filed cases, began working with leading experts and scientists, and ultimately led the negotiations leading to settlement with Bayer.

14. What is it about Yaz that makes it more dangerous than other birth control pills?

Yaz® is different than other birth control pills because it contains a different type of chemical that Bayer created called drospirenone. Birth control pills containing this new chemical include Yasmin®, Yaz®, Ocella®, Gianvi®, Beyaz®, and Safyral®. If you used any of these and had a blood clot, we can help you.

15. Why does BurgSimpson want to represent me?

It gives us great satisfaction to help women who have been injured by Yaz®. We have represented women in birth control litigation for nearly a decade – first in Ortho Evra®, now in Yaz®. Our results are outstanding. Our passion is proven. We want to make sure that Bayer is held accountable to the women it has injured.

16. Can any law firm be effective in defective drug litigation?

We believe there are very few law firms that have the right resources, size, and experience to fight against the most powerful drug corporations in the world and win. Winning is what we have been doing for more than 15 years at BurgSimpson.

17. Has BurgSimpson received awards and recognition for the quality of its legal work?

Yes. Our firm is one of the most highly recognized and decorated firms in the country in this area of the law. As we have worked hard for our clients, the recognition has followed. See our awards.

18. Is this a class action?

No. Your claim is an individual claim and will be evaluated separately from any other claims.

19. If I have made a full recovery and have no current symptoms, do I still have a claim?

Yes. The majority of women have recovered well. However, if you suffered a blood clot and you received medical treatment, are at a higher risk for future injuries, and for some period of time you suffered from pain, disability, and discomfort, then your injuries should not be minimized.

20. How will my case be evaluated if I have not fully recovered?

No two cases are identical. Some have permanent injuries, disabilities, and pain that may never resolve. We will help you receive fair compensation taking into account the extent to which you have been injured, both in the past, and, where your injuries continue, into the future.

We’ve been involved in the Yaz/Yasmin litigation from the very beginning.
