What to Do If You Are In an Auto Accident
Auto accidents are frightening and take us by surprise. Even a minor accident can cause panic. Most people will be in an auto accident at some time in their lives. Learning what you should do, before an accident occurs, can help to ensure that you will take the proper action, protect your legal rights, and possibly save lives.

Some of the biggest mistakes most people make are immediately after a crash while they are still frightened, confused, and sometimes very angry. Don't expect your actions during this period of heightened emotions to be overlooked.
What to do on the scene, immediately following an accident:
- If possible, move your vehicle out to the side of the road or a safe spot out of the flow of traffic, but do not leave the scene.
- Check for injured parties. Make sure that anyone who can walk on their own moves to a safe location. Even someone who is up and moving around may be in shock or too confused to do this without prompting. Do not move an injured person unless it is necessary to prevent further injury, such as someone who is lying in the flow of traffic.
- Contact the authorities. If someone is injured, request an ambulance. Even if no one appears to be injured you must call the police.
- Get contact information from everyone involved including other drivers, passengers and witnesses. This includes names, addresses, and phone numbers of everyone involved, plus driver's license numbers, and insurance carriers of all drivers. Also get the license plate number and the year, make, and model of every vehicle involved.
- Take photos of the vehicle or vehicles involved, the area surrounding the accident, injuries, skid marks, and anything else that may be relevant to the accident, such as obstacle in the road, pot holes, etc.
- Do not admit fault. Even if you believe you may have been at fault or partly at fault, other contributing factors which you are not aware of may be involved and any statement that you make could hurt you in court.
- Do not discuss the events of the accident with anyone other than the police.
What to do after you leave the scene:
- If you have not received medical attention on the scene, seek immediate medical attention when you leave the scene, even if you do not think you are hurt. You may be in shock and you may have injuries that you are not aware of.
- Document everything. Write down everything that you remember about the accident, as soon as possible, before the details start to fade from your mind. You can do this as soon as you get home or even while waiting in the emergency room, if you are able.
- Call an experienced auto accident attorney. Even if you do not expect to go to court, others involved in the accident may file a claim against you.
- Report the accident to your insurance company.
- Do not sign anything. Your insurance company, the other driver's insurance company, or representatives of other parties involved in the accident may approach you with documents. No matter how innocent these documents appear to you, do not sign anything without your attorney's approval.
