ATV Accident Attorneys

As the popularity of all terrain vehicles (ATVs) grows, so does the number of accidents, injuries and deaths caused by these dangerous machines. All too often, the victims are young children and inexperienced riders who are unaware of the danger. While all ATV pose some risks, the Yamaha Rhino, on the market since 2003, is unusually prone to rollover even at low speeds and on smooth terrain.
Problems with the Yamaha Rhino
The Yamaha Rhino has a high center of gravity. It is top heavy and narrow, making it rollover easily. Even though ATVs are create and sold for off-road use, the Rhino’s design allows it to rollover during low speed turns and on level ground.
Models from 2004 through 2007 were sold without doors, leaving occupants unprotected in the event of a rollover.
Injuries and deaths
Although they are often used for recreation, ATVs are not toys. The weight of an ATV can easily cause severe injuries and even crush a child to death in a rollover. In the Rhino, these injuries become even more likely and more severe because of the lack of protective doors to help keep arms and legs inside the vehicle.
The most common injuries are crushed limbs. When hands, feet, arms, or legs, get trapped between the body of the ATV and the ground, the force of impact can not only break bones but can actually pulverize the bone, requiring amputation.
At least one child, a twelve year old girl, has died from Yamaha Rhino rollover injuries.
Yamaha is aware of the problem, but does not recall the Rhino
In September, 2006, Yamaha issued a warning letter and warning labels to Rhino owners. The letter warned that, if your Rhino starts to tip over, putting your arms or legs out of the vehicle to try and stop the rollover could result in injuries.
In August of the following year, Yamaha announced that it would be installing doors and additional passenger handholds in new models, and that it would install the new features in 2004-2007 models free of charge. It did issue a recall of the Rhino.
These new safety features may help prevent injuries in the event of a rollover, but Yamaha has not made any changes to the design which will make the Rhino less likely to roll.
