David TeSelle is a nationally recognized trial lawyer. He tries cases and achieves proven results for his clients. His focus is on complex commercial litigation disputes - large and small, including "bet your business" cases, consumer and corporate fraud cases, bad faith cases, fiduciary duty breach cases, partnership and LLC disputes, property disputes, loan disputes, investor disputes, lender liability cases, shareholder derivative suits, financial-investment disputes, product liability cases and class actions. Mr. TeSelle has also successfully tried numerous personal injury and construction defect cases.
Mr. TeSelle is in charge of managing Burg Simpson's Commercial Trial Team, which includes over a dozen of the firm's trial lawyers. In 2009, Mr. TeSelle was co-lead trial counsel in the Pursuit v. UBS case where, after a mini-trial on the merits, a Connecticut State Court Judge found "probable cause" for securities fraud and ordered UBS to post a $35 million bond; and was also co-lead trial counsel in the Rapid Funding LLC v. James River Insurance Co. insurance bad faith jury trial in the United States District Court of Colorado, where the jury awarded his client $5.35 million in damages, including $2.35 million in punitive damages. Mr. TeSelle was also recently appointed, along with the firm, by the United States District Court of Colorado as local liaison counsel representing a class of investors in a Madoff-related class action matter with damages approaching $1 billion. Mr. TeSelle has also met the standards of excellence for selection in 2009 as one of the American Trial Lawyers Association top 100 Trial Lawyers. Mr. TeSelle has achieved the highest rating from his peers for quality of legal work, professionalism, and ethics by receiving an "AV" rating by Martindale-Hubbell.
Mr. TeSelle is a graduate of Columbia College of Columbia University in New York, NY, and the Dickinson School of Law (now Pennsylvania State University's law school). Mr. TeSelle joined Burg Simpson in 1998, after practicing for several years in the Philadelphia, Pennsylvania area. In his 11-plus years in Burg Simpson's Denver, Colorado office, he has successfully handled and tried in state and federal court, as well as in arbitration proceedings, cases in many diverse areas and has several jury verdicts in excess of $1 million. Mr. TeSelle is also a member of Burg Simpson's catastrophic personal injury and mass tort trial teams.
Mr. TeSelle is currently the leader of a nationwide consortium of prominent law firms investigating and pursuing claims arising from the financial collapse on Wall Street. He has spoken at several national conferences and local seminars on the topic. He has also consulted several state and local governments regarding their investment losses and has advised them on how best to recover losses that resulted from fraud or other mis-management of funds.
Mr. TeSelle prides himself on maintaining a "business focus" for his clients, and for tailoring the litigation strategy to meet the business or personal goals set with the clients at the outset of the case.
